Terms of Service

Version 1.1 · Effective 28 May 2026. By placing an order, you agree to these terms.

These Terms of Service ("Terms") govern your use of Tailwise ("the service", "we", "us"), operated by Marinus Klasen as a sole proprietorship in the Netherlands. Please read them. They are short on purpose.

1. Agreement

By creating an account, placing an order, or running the Tailwise agent against our collector, you ("you", "Customer") agree to these Terms, to our Privacy Policy, and to our Data Processing Agreement, which is incorporated by reference. If you are agreeing on behalf of an organisation, you confirm you have the authority to do so. If you do not agree, do not use the service.

2. The service

Tailwise is a server log monitoring service. You install a small bash agent on the servers you choose. The agent runs on a schedule and ships new lines from the log files you explicitly point it at to our EU-hosted collector. Tailwise classifies those lines, stores recent lines on a rolling basis, and emails you when fatals, errors, or resource issues appear. The service is intentionally narrow: it reads only what you send it, it does not touch your code or databases, and it is not a replacement for full observability or an SLA-backed monitoring platform.

3. Subscriptions, trial, and billing

Tailwise is sold on an annual subscription at $89 per year, which covers up to three sites (servers) under a single account. New subscriptions include a 14-day free trial; unless you cancel before the trial ends, billing begins automatically and continues on an annual auto-renewing basis until cancelled.

Payments are processed by Stripe. You can view invoices, change your payment method, and cancel from the Stripe customer portal linked in the site navigation. Cancellation takes effect at the end of the current paid period; fees already paid are non-refundable except where required by law, and EU consumers retain any statutory right of withdrawal that applies.

If we introduce a monthly plan or other pricing options in future, the terms shown at checkout will apply to those orders.

4. Your account and access tokens

Each subscription is issued one access token. Keep it secret. You are responsible for activity carried out with your token, including any logs shipped to our collector under it. If you believe a token has been exposed, email marinus@mklasen.com and we will rotate it.

5. Your responsibilities

  • Use the service lawfully. Do not use it to process data you are not entitled to process, and do not send special-category personal data, payment card numbers, or other secrets through the agent.
  • Provide accurate signup and billing information, and keep your alert email address up to date.
  • Respect the site limit of your plan (three servers per subscription). If you need more, contact us; do not stack tokens or otherwise circumvent the cap.
  • Do not use the agent or collector to deliver malicious payloads, probe our infrastructure, or send synthetic traffic intended to disrupt the service.
  • You are responsible for your own backups, your own incident response, and for acting on the alerts Tailwise sends you.

6. Your data and ours

You own the log data you send to Tailwise and any personal data inside it. For that data, you are the controller and Tailwise is the processor: the terms in our Data Processing Agreement apply. You grant Tailwise the limited right to receive, store, scan, classify, and alert on the log lines you send, solely to provide the service. We do not sell your data, we do not share it with advertisers, and we do not send it to third-party AI providers.

Tailwise retains all rights in the service itself, the website, the agent script, and our brand. You receive a non-exclusive, non-transferable right to use the service for the duration of your subscription.

7. Service availability

Tailwise is provided on a best-effort basis. We aim for high availability of the collector and the alert pipeline, and we run it on our own sites first, but we do not offer a formal uptime SLA. Maintenance windows, upstream provider issues, and the usual realities of running infrastructure mean some downtime is possible. The service is provided "as is" and "as available", without warranties beyond those that cannot be excluded under applicable law.

8. Limitation of liability

To the maximum extent permitted by law, Tailwise is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of revenue, profits, goodwill, or data, even if we were advised of the possibility. We are not liable for errors, outages, security incidents, or losses on your own systems that Tailwise failed to detect or alert on: Tailwise is a monitoring aid, not a guarantee that every issue will be caught.

Our total aggregate liability under these Terms in any matter is limited to the fees you actually paid to Tailwise in the twelve months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under mandatory EU or Dutch law, including for intent or gross negligence.

9. Indemnification

You will indemnify Tailwise against third-party claims arising from your unlawful use of the service or from data you sent us that you were not entitled to send. Tailwise will indemnify you against third-party claims that the service itself, used as documented, infringes that third party's intellectual property rights. In each case, indemnification is subject to the indemnified party giving prompt written notice and reasonable cooperation, and is capped at the limits in section 8.

10. Termination

You may cancel your subscription at any time from the Stripe customer portal. On cancellation, your access continues until the end of the current paid period, after which the token is deactivated and your stored logs are deleted in line with the retention rules in the DPA and Privacy Policy.

We may suspend or terminate your access if you materially breach these Terms, if your use puts our infrastructure or other customers at risk, or if we are required to do so by law. Where reasonable, we will give you a chance to fix the issue first. On termination by us for breach, fees already paid are non-refundable.

11. Modifications to the service and these Terms

Tailwise will evolve. We may add, change, or remove features over time. We will not silently degrade the core promise of the service, which is shipping your selected log lines to our collector and alerting you on issues.

We may also update these Terms. Material changes (anything affecting pricing, scope, liability, or your rights) will be announced by email to active customers at least 30 days before they take effect, and the version and date at the top of this page will be updated. Continued use of the service after the effective date means you accept the new Terms; if you do not accept them, you may cancel before they take effect and request a pro-rata refund for the unused portion of any prepaid annual period.

12. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. The competent courts of the Netherlands have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that EU consumers may also bring proceedings in the courts of their own country of residence and benefit from any mandatory consumer protection law of that country.
